research project #3 (social theory/ applied anthropology) - one of the more extremist articles we read at piksi had, through some (il)logic, all women enjoying heterosexual identity/sex doing so only because they have been told they do so (have been defined) by the dominant patriarchic paradigm. what this (RP#3) project would do, instead, and kind of in a fun parallel, is reveal the "modernization project" for an ethnocentric westernization playing off a deep-seated inferiority complex - that there is this insatiable (and superficial) hunger for "science", "technology", and "development" in non-Western societies only because they have been told they do so (have been defined) by the dominant imperialist paradigm.

maliha - i need to write more. :-/ i agree. it's just...well, i'll try to write more when i get back from 'umrah, iA.
as for fiqh of minorities...the simple/simplistic story is that i feel there's a wealth of resource, richness, within the existing madhahib, and that many people calling for a new madhhab (i'm not saying this is sh.bin bayyah, obviously. in the conversation with farooq i was more reacting to people like murad hoffman who call for a 'western madhhab' - and how many hopskip from 'traditional madhahib' -> 'fiqh al-aqalliyat' -> 'new madhhab altogether') only do so because they haven't been actually exposed to that richness and latitude already there. and that: while i do see the existence of this huge muslim minority in the west as a situation without historical precedent, etc, i think holistic and thought-through fatawa on the part of scholars of existing madhahib who fully understand the situation of muslims in the west as well as traditional modes, methodologies, etc, would serve the same function many of those calling for change while at the same time maintaining a...continuity with tradition, would utilize the same usul, instead of trying to strike out from scratch... i could go on, but as you can see the thoughts aren't yet well-organized. someday, when i've started writing a lot once more, i'll lay out the argument in much clearer fashion. (:

I actually attempted to write a "research" paper on the topic of madhahib. But I think I ended up further away from any conclusion; than when I began.
I studied a lot of the material; history; etc. Whatever I could basically find in the English language (which I know is very limited).
One thing I came out of it for sure is this (and it's not really an original thought either): given the complexity of the world, and the overhaul impact of modernity/post modernity.. we can't rely on scholars alone to come up with Fatwas. An ideal scenario would be economist; scientist; philosophers; scholars; sitting in one room and each informing the decision.
That the continuity of tradition has to be balanced with the nuances and complexity of today's world. And the scholar can no longer be the all seeing; all knowing phenomenon (and it's not fair on them either).
The problem I do see with that approach is that everyone of those "scholars" would want to be the ultimate voice in the outcome. Egoes colliding and whatnot.
It's a hard topic to discuss on comments; and my thoughts are much nuanced than that. but it's just a little slice of my overall thoughts.
